MEDIATION IS AN ALTERNATIVE DISPUTE RESOLUTION PROCESS.
Parties meet with a neutral third party, the mediator(s) for purposes of facilitating an agreement between the parties.
During the mediation process the parties are assisted in considering various options and to generate solutions that will meet their needs.
In the Children’s Act 38 of 2005, mediation is stipulated as the preferred method of dispute solution between co-holders of parental responsibilities and rights.
It is an alternative to litigation in preparing parties for separation and/or divorce.
It guides parties through the complex process of divorce or separation.
